Nanny PERM process For Labor Certification
Employers must perform six tasks:
a) Offer a noncitizen “permanent” position beginning no later than the date that the noncitizen becomes a permanent resident.
b) Request a prevailing wage (PWD) determination from the U.S. Department of Labor (DOL). The DOL typically takes four months to issue a prevailing wage.
c) Conduct the following recruitment activities in a good faith effort to recruit a U.S. worker to fill the position offered to the noncitizen:
Place a notice describing the job in detail, including the offered wage, at the location where the noncitizen will work for ten consecutive business days (from now on, “Job Posting”).
Two advertisements in a major newspaper (Sunday edition).
Place a minimum 30-day job order with the State Workforce Agency (SWA). In California, the SWA is known as Cal jobs.
d) Prepare a written explanation for why any U.S. worker who applied for the position was rejected for lawful job-related reasons only.
e) Application must be submitted to the ETA Application Center.
f) The employer may be required to respond to additional requests from the Certifying Officer for documentation of his recruitment efforts.

Can A Labor Certification Be Filed Before The PWD Is Issued?
No, we need a PWD before we can file the labor certification. As a result, if time is of the essence, we file the PWD first, then perform the recruitment shortly following based on the most significant possible wage for the Nanny. We can file the labor certification as soon as the PWD is issued. There is no need to wait for the PWD to be issued if the Nanny position is filled at level 4. Usually, we must wait for the PWD before recruiting for all other posts because the wage for a computer programmer, for example, might be 80,000 for level 1 and 150,000 for level 4. The differential for Nanny positions is between $13 and $16. Typically, it takes about six months from the time a request for labor certification is filed to receive approval. The pace could be accelerated or slowed down depending on the current workload and circumstances. The officer may also conduct an “audit” of the business in search of recruitment documentation and other compliance issues. (Audits are computer-generated and can be triggered by certain conditions.)
The filing of an immigrant petition follows the approval of a labor certification. The United States Citizenship and Immigration Services (USCIS) now offers “premium processing,” a service that reduces the approval time for immigrant petitions to 15 days. A Request For Evidence (RFE) could add a month to the duration of the process.
It will take approximately 5 months to file the labor certification portion of the application (1 month to prepare all relevant documentation + 4 months to file and receive PWD results), 6 months for approval, 1 month to get the immigrant petition approved, and possibly an additional year before we can file the adjustment of status. Before the regression, the entire project could have been completed in a maximum of one year. The visa application process has become significantly more time-consuming in recent years, with current trends indicating that it will take between two and two and a half years. As we have learned through experience, the visa expiration date can become valid very quickly, varying from month to month and year to year.
