Tips And Pitfalls To Watch Out
Immigrants who re-enter the U.S. with Advanced Parole must be aware that they could be denied admission due to other factors not relating to a previous unlawful entry to the U.S. or periods of unlawful presence in the U.S. A CBP officer can deny entry due to other immigration violations such as:
- In the past, providing untruthful information to an immigration officer or on immigration applications.
- Criminal convictions or even arrests that did not result in a conviction.
- Multiple unlawful entries to the U.S.
- Helping family members or other individuals enter the U.S. without documents.

Detailed Information About DACA
When a country suffers from internal conflicts or natural disasters, foreign nationals from some countries currently residing in the United States are granted temporary protection against removal. In consultation with the Secretary of State, the Secretary of Homeland Security decides whether to grant TPS for 6 to 18 months. Certain countries can have their TPS status extended if problems persist.
Immigrants with TPS status who wish to apply for Advance Parole must also submit Form I-131, along with supporting documentation and the filing fee. Applicants for TPS may request Advance Parole for reasons unrelated to education, employment, or humanitarian considerations. TPS applicants may apply for Advance Parole to take a vacation. TPS recipients must also fully comply with the requirements outlined in the Advance Parole application and approval, similar to DACA recipients.
When applying for Advance Parole and a green card, all forms must be filled out accurately and completely. Failure to submit completed forms with the necessary supporting documents may result in lengthy delays and adverse effects on your immigration status. Contact our office immediately if you need to travel outside the United States due to an emergency so that we can prepare an expedited Advance Parole application that will be approved.
Depending on the specifics of your case, our office can also assist you in determining whether applying for Advance Parole is the best course of action. Remember that an Advance Parole authorization document does not guarantee re-entry into the United States. As mentioned, when you present yourself for re-entry, a CBP officer will ask questions about your travel and immigration history. Our office will also prepare you to answer these questions clearly and truthfully.
